When purchasing or refinancing your property, you must  decide how you will hold title before escrow closes. Consult your  attorney and accountant to advise you.\u00a0 Here is a good explanation of your options:<\/p>\n<p><strong>SOLE OWNERSHIP<\/strong><\/p>\n<p>1. <span style=\"text-decoration:underline;\">A Single Man \/ Woman<\/span> &#8211; a person who has never been married.<\/p>\n<p>2. <span style=\"text-decoration:underline;\">An Unmarried Man \/ Woman<\/span> &#8211; a previously-married person (now divorced or widowed).<\/p>\n<p>3. <span style=\"text-decoration:underline;\">A Married Man\/Woman, as His\/Her Sole and Separate Property<\/span> &#8211; a married person who is acquiring title in his\/her name only. <strong>Note<\/strong>:  Due to community property laws in California, the spouse must consent  by signing a &#8220;quitclaim&#8221; deed or &#8220;interspousal transfer&#8221;.<\/p>\n<p><strong>CO-OWNERSHIP<\/strong><\/p>\n<p>4. <span style=\"text-decoration:underline;\">Community Property<\/span> &#8211; title held equally by husband and wife. Has some tax benefits, such  as &#8220;step up&#8221; in value basis upon death of one spouse. Can be with or  without <em>right of survivorship<\/em>.<\/p>\n<p>5. <span style=\"text-decoration:underline;\">Joint Tenancy<\/span> &#8211; title held <span style=\"text-decoration:underline;\">equally<\/span> by any number of persons, including husband and wife. Owners have <em>right of survivorship<\/em> (upon death of one owner, the other owner inherits it all).<\/p>\n<p>6. <span style=\"text-decoration:underline;\">Tenancy in Common<\/span> &#8211; title is held by any number of persons, including husband and wife, but ownership does not have to be equal. <strong>Note<\/strong>: Each owner&#8217;s % of ownership must be stated.<\/p>\n<p>7. <span style=\"text-decoration:underline;\">Tenancy in Partnership<\/span> &#8211; any number of partners.<\/p>\n<p>8. <span style=\"text-decoration:underline;\">Title Holding Trust<\/span> &#8211; owners can be individuals, groups of persons, partnerships, corporations, or a living trust.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Vesting of your property title may seem like a minor decision now, but it has a critical effect on your taxes, your inheritance, and your financial future.
